An Act to establish penalties for violating the Terms of Residency and Requirements for Membership in Congress
Whereas Clause 1.2.7 of the Charter mandates that legislation be created to establish penalties for violating the Terms of Residency:
And whereas Clause 2.1.2.6 of the Charter mandates that legislation be created to establish penalties for violating the Requirements for Membership in Congress:
Be it enacted by the Congress of the Democratic Socialist Assembly:
Chapter 1: General Provisions
1. This Act may be cited as the Charter Violations Act 2015.
2. This Act shall come into force upon its passage.
Chapter 2: Violating the Terms of Residency
1. If a Resident violates any of the Terms of Residency, the Minister of Justice shall impose upon such Resident a probation period of seven (7) days, beginning the day that the Minister of Justice gives notice of probation, in which the non-compliant Resident may become compliant once again in order to be spared further disciplinary action.
2. If Residents under probation fail or neglect to become compliant by the end of their probation period, they shall immediately forfeit their Resident status and be ejected from the DSA by the Minister of Justice, if the Minister of Justice has the Administrative Privileges to do so. Otherwise, the non-compliant Residents shall be ejected by the World Assembly Delegate per the Minister of Justice's formal recommendation to the World Assembly Delegate to do so.
3. The Minister of Justice shall extend the probation period for nations that show any sign of progress towards compliance with the Terms of Residency.
Chapter 3: Violating the Requirements for Membership in Congress
1. If a Member of Congress violates the Requirements for Membership in Congress, the Minister of Justice shall impose upon such Member of Congress a probation period of seven (7) days, beginning the day that the Minister of Justice gives notice of probation, in which the non-compliant Member of Congress may become compliant once again in order to be spared further disciplinary action.
2. If Members of Congress under probation fail or neglect to become compliant by the end of their probation period, they shall immediately forfeit their Membership in Congress and be suspended from participating in Congressional activities, per the Minister of Justice's formal recommendation to the Secretary-General to do so.
3. If Members of Congress are in violation of any of the requirements for Membership in Congress during an act of Congress, such Members of Congress shall be immediately suspended from participating in the act by the Secretary-General, and any of those Members of Congress' contributions to the act of Congress shall be discounted from affecting the outcome.
