This thread will serve as a voting thread for the Decentralization Of Presidential Executorship (DOPE) act. As a Charter amendment, it will require a 2/3 majority vote in congress to pass.

In effect, this legislation will abolish the Presidency and delegate the few jobs assigned to it to the rest of the Cabinet, in addition to renaming this presidentless Cabinet to "the Council" to be more appropriate to the lack of an explicit leader.

Chapter I: General Provisions
1: This act may be cited as the DOPE Act.
2: Throughout this document, in the enumerations of the various amendments, bold text shall indicate a modification, whereas strikethrough text shall indicate a removal.
3: This act shall come into conclusion at the time of the following cabinet election, at which point there will be an election without a role of President on the ballot for the "First Council".

Chapter II: Charter Amendments
1: The entries for "Cabinet" and "Cabinet Aide" in the Key Definitions shall be replaced as follows:

Cabinet - An antiquated term for the Council (see definition).

Additionally, the following definitions should be added to the Key Definitions:

Council - The group of Councilors which the Congress elects from among its peers to manage specific areas of government and to perform certain duties on behalf of the Congress in the interests of the DSA.
Council Aide - A Resident in good standing that is appointed by a Council Member to assist in upholding the duties of that Member's Council position.

2: Subsection 2.2.1 ("Establishment and Composition") Clause 2 shall be amended as follows:

The Cabinet Council shall consist of the President of Congress, World Assembly Delegate, Secretary General, Minister of Justice, Minister of Foreign Affairs, Minister of Domestic Affairs, and Minister of Roleplay.

3: Subsection 2.2.2 ("Duties") Clause 2 shall be struck from the Charter, text provided here for reference

All other Cabinet Ministers are fully accountable to the President of Congress and shall in earnest try to fulfill all reasonable requests made by the President of Congress as they pertain to their respective duties.

4: Subsection 2.2.4 ("The President of Congress") shall be entirely struck from the Charter.
5: Subsection 2.2.5 ("The World Assembly Delegate") shall be entirely rewritten as follows:

1. The World Assembly Delegate shall represent the DSA at the World Assembly and its subsidiary organs.
2. Should the position of World Assembly Delegate of the Democratic Socialist Assembly region be occupied by a Resident who has not been elected in accordance to the rules of this Charter, the Founder may eject that World Assembly Delegate at the request of the President of Congress Council.
3. The World Assembly Delegate, when not also the President of Congress, shall execute the recommendations of the rest of the Council as they pertain to Administrative Privileges without hesitation or prejudice.
4. Should the position of President of Congress fall vacant, the World Assembly Delegate shall serve as the President until the end of the term if the vacancy occurs within twenty-one (21) days or a special election is held.
5. When a World Assembly Delegate's term has ended without having been re-elected, then the outgoing World Assembly Delegate shall promptly resign at the request of the incoming World Assembly Delegate. Failure to comply with this request shall be grounds for ejection by the Founder and further disciplinary action.
6. The World Assembly Delegate shall be permitted to approve any proposed World Assembly resolution available to the World Assembly Delegate for scrutiny and approval in the World Assembly.
7. The World Assembly Delegate may author or co-author World Assembly resolutions as long as the World Assembly Delegate publicly declares such an endeavor prior to submitting it for approval; and that such a resolution is in accordance with DSA Regional Principles.
8. The World Assembly Delegate shall cast a symbolic vote in the World Assembly consistent with a simple majority of voting Residents.

6: Subsection 2.3.5 ("The Founder") Clauses 1, 3 and 4 shall be rewritten as follows:

1. The Founder may only exercise Administrative Privileges at the request of the Congress and/or President of Congress a majority of the Council, and may not disrupt or inhibit the ability of a democratically-elected World Assembly Delegate to exercise Administrative Privileges.

3. The Founder may eject and/or ban a non-democratically elected World Assembly Delegate at the request of the President of Congress Council.
4: The Founder may not stand for election or serve as a Cabinet Minister Councilor or the High Judge.

7: Subsection 3.1.2 ("Organization") Clause 1 shall be amended as follows:

The Forum shall consist of roles to identify users by the following subdivisions:
● Foreign Visitors
● Foreign Diplomats
● Residents
● Members of Congress
● Ambassadors
● Ministry-Specific Roles
● Cabinet Ministers Councilors
● Secretary General
● The High Judge
● The President
● The World Assembly Delegate
● Forum Nation

8: Subsection 4.1.4 ("Expulsion by the Cabinet"), in addition to being renamed to "Expulsion by the Council", shall be amended as follows:

1. In certain extraordinary circumstances, it may be that the executive body of the region is required to perform an expulsion in order to best protect the interests and/or health of the region without waiting for an expulsion by the court to be completed.
2. By a simple majority vote, the Cabinet Council may expel a resident of the region who has committed an act of extraordinary misconduct.
3. Upon the passage of a Cabinet Council vote, the subject resident shall be removed from the DSA.
4. Repeated re-entry into the DSA by the expelled party will result in a temporary ban until the expulsion has been reviewed by the Court.
5. The President shall issue a statement on behalf of the cabinet Council shall issue a statement simultaneously with the expulsion, and evidence used in conjunction with the expulsion shall be offered for distribution to any resident who requests to view such material, subject to potential restrictions.
6. The Cabinet Council may apply to the court of the DSA to have the ban on a Cabinet Council-expelled resident extended if the nature of the charge is deemed to warrant it.
7. The Court of the DSA will have the final say on all expulsions undertaken by the Cabinet Council.

9: Additionally, all other references to "cabinet", "cabinet minister" or "cabinet member", "cabinet aide", or "minister" throughout the Charter shall be replaced with "Council", "Councilor", "Council Aide" and "Councilor" respectively, with the understanding that this renaming is merely cosmetic.

Chapter III: Rules and Procedures Amendments
1: Subsection 1.1.1 ("The Returning Officer") Clause 1 shall be amended as follows:

The Returning Officer for all elections shall be the Secretary-General. In the absence of the Secretary-General, the President of Congress World Assembly Delegate shall be the Returning Officer.

2: Subsection 1.1.3 ("Eligibility") Clause 3 shall be amended as follows:

Any general election which has no declared candidates by the commencement of the voting period shall result in a special election. Should the special election have no declared candidates by the commencement of the voting period, the President members of the Council may nominate a Member of Congress for the open Cabinet Council position.

3: Subsection 1.2.1 ("Cabinet Elections"), in addition to being renamed to "Council Elections", shall be amended as follows:

If a Cabinet Council or High Judge position is vacated for any reason, the Returning Officer shall hold a special election for the position in accordance to the timing and procedures laid out in Subsection 1.2.4 of this document. While the special election is taking place, the President Council must appoint an interim minister within 2 days of the position being vacated. If the special election is for a Cabinet Council position and the President Council is unable to find an interim minister, the President remaining Councilors may take up the role until the election is complete.

4: Subsection 1.2.5 ("Executively Proposed Nominations") Clause 1 shall be amended as follows:

A confirmatory congressional vote shall be held for nominees to the role of Administrator Emeritus and for vacant Cabinet Council positions that have remained unfilled following a special election.

5: Subsection 2.1.2 ("Categorization of Legislative Proposals") shall be amended as follows:

1. Proposals shall be presented under at least one of the following categories:
● Charter Amendment, for legislation enacting any form of amendment to the Charter.
● Procedures, for legislation relating to the operation of Congress and/or the Cabinet Council.
● Legislation, for general legislation enacting Regional laws and/or regulations.
● Referendum, for legislation confirming the appointment of interim Cabinet Ministers by the President of Congress Councilors by the present Council.
● Role Play, for legislation relating specifically to Role Play.
● Commendation, for proposed Bills of Congressional Commendation.
● Nomination, for bills nominating a member of the DSA to a role that requires
Congressional approval.

6: Subsection 2.3.2 ("Legislative Voting Procedures") Clause 1 shall be amended as follows:

All non-electoral votes shall be conducted by the Returning Officer, who shall be:
● the Secretary General, or
● if the Secretary General so determines, a Member of Congress appointed by the Secretary General,
or
● in the absence of the Secretary General, a Returning Officer appointed by the President Council

6: Additionally, all other references to "cabinet", "cabinet minister" or "cabinet member", "cabinet aide", or "minister" throughout the Rules and Procedures shall be replaced with "Council", "Councilor", "Council Aide" and "Councilor" respectively, with the understanding that this renaming is merely cosmetic.

Chapter IV: Discord Administration Amendments
1: Subsection 1.1.1 ("The Administrator") shall be amended as follows:

1. The Administrator shall be the owner and sole administrator of the Discord Server. A new role shall be created named, Administrator.
2. The Administrator shall be nominated by the Minister of Domestic Affairs a two-thirds majority vote of the Council and approved with the consent of Congress pursuant to nomination procedures.
3. The Administrator will be responsible for fulfilling all reasonable requests of the Cabinet Council as they pertain to user permissions relevant to their office.
4. The Administrator will be responsible for creating and interpreting rules of conduct and administration as they pertain to the Discord.
5. Should the Administrator role fall vacant, the President Councilor of Domestic Affairs shall serve as the Administrator of the Discord server until a new Administrator is appointed.

2: Subsection 1.2.1 ("The Moderation Staff") Clause 7 shall be amended as follows:

Members of the Moderation Staff may not serve as a Cabinet Minister Councilor.

Chapter V: Executive Appointments Amendments
All references to "cabinet", "cabinet minister" or "cabinet member", "cabinet aide", or "minister" throughout the Executive Appointments shall be replaced with "Council", "Councilor", "Council Aide" and "Councilor" respectively, with the understanding that this renaming is merely cosmetic.

Chapter VI: Miscellaneous Provisions
1: Any references to a duty of the President in legislation that is not directly covered by this Act shall be taken to be a duty of the entire Council following its passage.
2: Any references to the Cabinet, a Minister, or a Cabinet Aide in legislation that is not directly covered by this act shall be taken to refer to the corresponding updated terms.
